Terms of service

Last updated: 9 August 2026

1. Agreement

By buying or using an Orca eSIM, you agree to these terms. If you don’t agree, don’t use the service.

2. What we provide

Orca resells eSIM data plans for travel. We deliver an eSIM and a QR code by email; your connectivity is carried over partner mobile networks in your destination.

3. Eligibility

You need an eSIM-capable, carrier-unlocked phone. See device compatibility before you buy — it’s your responsibility to confirm your device works.

4. Orders & payment

Prices are shown in US dollars and charged in Philippine pesos (PHP) at the equivalent amount, at the time of purchase through our payment processor, Paycools. Placing an order authorises that charge.

5. Delivery

Your eSIM and QR code are sent to the email you provide, usually within minutes of payment. If it doesn’t arrive, check spam, use Find my order, or contact hello@orcaesim.com.

6. Refunds

An eSIM is a digital product delivered immediately. Once it has been installed on a device it is tied to that device and can’t be returned or reissued.

Before you install it. If you haven’t installed the eSIM yet, email us within 30 days of purchase with your order number and we’ll refund it in full.

After you install it. Once installed, we can’t refund a change of mind, unused data, or a plan bought for the wrong destination.

If it doesn’t work. If your eSIM won’t connect and we can’t fix it with you, we’ll replace it or refund it in full — installed or not. That’s the case whenever the fault is ours or the network’s. It doesn’t cover a phone that’s carrier-locked or not eSIM-capable, so please check your device before buying.

We refund to your original payment method where the payment provider supports it. Where it doesn’t, we’ll agree another way with you — you won’t be left out of pocket because of how you paid.

7. Acceptable use

Use your eSIM lawfully and for personal travel data. Don’t resell, tamper with, or use the service to break the law or a network’s fair-use terms.

8. Disclaimers & liability

Orca resells data plans carried on partner mobile networks. We don’t own or operate those networks, so we can’t guarantee coverage, speed, or uninterrupted service in any particular place — those depend on the local network, your device, and conditions outside our control. Coverage and speed descriptions are indicative, not promises.

To the fullest extent the law allows, the service is provided “as is” and “as available”.

Where liability can lawfully be limited, our total liability for any claim relating to an order is limited to what you paid for that order. We aren’t liable for indirect or knock-on losses — missed bookings, lost business, or charges you run up on another network.

Nothing here removes rights you have under consumer law that can’t be excluded.

9. Changes & governing law

We may update these terms. If a change is material we’ll post it here and update the date at the top of this page.

These terms are governed by the laws of the Republic of the Philippines, and disputes will be handled by the courts of the Philippines. If you’re buying as a consumer from another country, this doesn’t remove protections you have at home.
